Welcome to Soakr ("the App"), operated by Dustin Wells ("we," "us," or "our"). By downloading, installing, accessing, or using Soakr, you agree to be bound by these Terms of Use.
Soakr is a mobile application that helps users discover and explore hot springs. The App provides location-based information including maps, descriptions, photos, reviews, and other content related to hot spring locations.
You must be at least 13 years old to use Soakr. If you are under 18, your parent or legal guardian must have reviewed and agreed to these Terms.
Many hot springs listed in Soakr may be located on private property, restricted land, or areas with hazardous conditions. Visiting any location listed in this App may result in serious injury or death. You are solely responsible for verifying legal access and assessing safety risks before visiting any location.
Soakr does not guarantee that any hot spring listed is located on public land, open, safe, accurately described, or permitted for bathing.
Before visiting any hot spring, you are solely responsible for verifying land ownership, obtaining permits, checking current conditions, assessing safety risks, and complying with all applicable laws.
Hot springs are inherently dangerous. By visiting any location discovered through the App, you voluntarily assume all risks including thermal burns, drowning, harmful bacteria, unstable terrain, wildlife encounters, toxic gases, altitude sickness, and legal consequences of unauthorized access.
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant accuracy of locations, conditions, or safety information.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP OR VISITS TO LOCATIONS DISCOVERED THROUGH IT. Total liability shall not exceed the amount you paid us in the preceding 12 months, or $50, whichever is less.
You agree to indemnify and hold harmless Dustin Wells and Soakr from any claims arising from your use of the App, visits to locations, violation of these Terms, or content you submit.
By submitting content, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use such content in connection with the App. You may not submit false, misleading, defamatory, or illegal content.
The App, its design, features, and original content are owned by Dustin Wells and protected by intellectual property laws.
Disputes shall be governed by Colorado law and resolved through binding arbitration in Denver, Colorado. You waive class action rights.

Property owners may request removal of listings on their private property by emailing hello [at] soakr.com with proof of ownership. We will acknowledge receipt within 5 business days and complete review within 15 business days.
